Website Terms of Use

Effective date: July 29, 2026

These Website Terms of Use (“Website Terms”) govern access to ignitedigitalcreative.com and other public websites operated by Ignite Digital Creative LLC (“Ignite,” “IDC,” “we,” “us,” or “our”). By using the website, you agree to these Website Terms. If you do not agree, do not use the website.

1. Website only; client agreements control services

The website provides general information about Ignite and allows users to contact us. These Website Terms do not replace a signed master services agreement, service agreement, statement of work, order form, data-processing agreement, or other written agreement (“Client Agreement”).

If a Client Agreement conflicts with these Website Terms, the Client Agreement controls for the services covered by it. A Client Agreement may be amended only as stated in that agreement, not merely by changing these Website Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter an agreement to use the website. If you use it for a business, you represent that you are authorized to act for that business.

3. Informational content

Website content is provided for general informational and marketing purposes. It is not legal, tax, financial, accounting, or other regulated professional advice. No website content creates a client relationship, fiduciary relationship, partnership, or guarantee.

4. Permitted use

You may use the website for lawful purposes. You may not:

  • Interfere with, damage, overload, probe, or bypass website security.
  • Introduce malware, automated abuse, or harmful code.
  • Scrape, copy, or reuse content except as permitted by law or written permission.
  • Impersonate another person or misrepresent your authority.
  • Use the website to violate law, platform rules, intellectual-property rights, privacy rights, or contractual obligations.
  • Submit passwords, access tokens, payment-card data, government identifiers, health information, or other unnecessary sensitive information through general forms.

5. User submissions

You retain ownership of information and materials you submit. You grant Ignite a limited, non-exclusive license to receive, store, reproduce, modify, and use those materials only as needed to respond to you, evaluate a proposed engagement, provide requested services, maintain security, and comply with law.

You represent that you have the right to provide submitted materials and instructions. Do not submit confidential or regulated information before an appropriate agreement is in place.

6. Intellectual property

The website, brand elements, text, graphics, software, templates, processes, and other materials are owned by Ignite or its licensors and protected by law. Except for limited personal or internal business viewing, no rights are granted without written permission.

Ownership, licensing, source files, work product, pre-existing materials, third-party assets, and portfolio rights for paid client work are governed exclusively by the applicable Client Agreement.

7. AI-assisted features and work

Ignite may use artificial-intelligence tools to assist with research, drafting, analysis, automation, support, creative production, or service delivery. AI output may contain errors and requires appropriate human review. Do not submit sensitive or restricted information to an AI-enabled feature unless Ignite has expressly approved that use.

Client responsibilities for verifying claims, approvals, rights, regulated content, and final deliverables are governed by the Client Agreement.

8. Third-party services

The website may link to or integrate with third-party websites, advertising platforms, CRM systems, scheduling tools, payment providers, and other services. We do not control independent third parties and are not responsible for their availability, content, security, or practices. Your use may be subject to their terms.

9. Privacy and electronic communications

Our collection and use of personal information is described in our Privacy Policy. By submitting a form, you consent to receiving communications necessary to respond to your request. Marketing email, call, or text consent is governed by the disclosure shown at the point of collection and applicable law.

10. No warranties

THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, IGNITE DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IGNITE AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION ARISING FROM THE WEBSITE.

IGNITE’S TOTAL LIABILITY ARISING FROM THE PUBLIC WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THIS LIMIT DOES NOT CHANGE ANY LIABILITY EXPRESSLY ACCEPTED IN A CLIENT AGREEMENT AND DOES NOT APPLY WHERE PROHIBITED BY LAW.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Ignite harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the website, your submitted materials, or your violation of these Website Terms or another person’s rights.

13. Changes and availability

We may modify or discontinue public website features and may update these Website Terms prospectively by posting a revised version and effective date. Material changes apply after appropriate notice where required. Changes to these Website Terms do not amend a signed Client Agreement.

14. Governing law and disputes

These Website Terms are governed by Nevada law, without regard to conflict-of-law rules. Courts located in Clark County, Nevada will have exclusive jurisdiction, except where applicable consumer law requires otherwise.

Before filing a claim, each party agrees to send written notice and attempt in good faith to resolve the dispute informally for at least 30 days.

15. General terms

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Website Terms without our consent; Ignite may assign them as part of a merger, reorganization, financing, or sale. Provisions that by their nature should survive termination will survive.
